Draft Charging Schedule Consultation

The Council consulted on a Preliminary Draft Charging Schedule (PDCS) between October and December 2014. The comments received and additional viability work carried out have informed the preparation of a Draft Charging Schedule (DCS).

The DCS sets out the proposed charging rates for Tamworth. The Council considers that these rates strike an appropriate balance between contributing to funding infrastructure and not putting development viability in Tamworth at risk. The DCS is also accompanied by the policies that the Council propose to adopt if CIL is approved.

In accordance with Regulation 16 the Draft Charging Schedule was subject to public consultation for 6 weeks between Friday 23rd October to Friday 4th December 2015.

18 representations were duly received during this consultation period which have been forwarded to the planning inspector for review as part of the CIL examination.

Details of the consultation including a summary of the representations are available in the Regulation 19 Statement of Consultation.

Modifications have been made by the Council to the Draft Charging Schedule as a result of this consultation and these are detailed in the Regulation 19 (d) Statement of Modifications along with a minor amendment to the Charging Zone Map in Appendix A to include National Grid Lines and reference numbers.

Examination

In accordance with Regulation 19 of the CIL Regulations 2010 (as amended) Tamworth Borough Council submitted the Draft CIL Charging Schedule for independent examination together with supporting evidence on 25 August 2017.

All those who requested to be notified and those who submitted a response to the Draft CIL Charging Schedule were notified of the submission of Tamworth Borough Councils Draft Charging Schedule and were kept fully informed of the progress of the examination.

Examination Hearing

The examination hearing took place on Wednesday 1st November 2017 and lasted one day.  All those who requested to be notified and who submitted a representation were informed of the hearing details, which took place at the Tamworth Council offices at Marmion House.

Post-hearing modifications consultation

Following the public hearing on 1st November 2017 Tamworth Borough Council has made some proposed modifications to the draft charging schedule. These proposed modifications consist of a number of suggestions to the draft charging schedule made during the hearing and subsequent modifications made by the Council.

The proposed modifications detailed in document CIL_EX_07 and associated maps were subject to a 4 week consultation period from Wednesday 22nd November to 5pm Wednesday 20th December 2017.

Consultation on the Tamworth CIL Charging Schedule Post-Hearing Modifications ended at 5pm on 20th December 2017. Representations made during the consultation period were forwarded to the inspector for her consideration. Copies of the representations are below:

On 13 February 2018 the council received the Final Report on the Examination of the Tamworth Borough Council CIL Draft Charging Schedule. The examiner’s report concluded that, “…subject to the modifications set out in Appendix A, the Tamworth Borough Council Community Infrastructure Levy Draft Charging Schedule provides an appropriate basis for the collection of the levy in that area.”

The Council will take the charging schedule (along with associated documents) to Full Council on 17th July 2018 for adoption.  It is anticipated that charging will commence on 1st August 2018.
