Land charges and searches

Local land charge searches give information held by the Council about a property. They are used by solicitors, buyers and mortgage lenders to reveal important information prior to completion of a property transaction. Local authority searches and personal searches are dealt with by our Legal Services team. This includes land charges and answering questions on form CON29.

All drainage enquiries on a Search are now conducted by Severn Trent Water Searches.

Highways questions which are answered by Staffordshire County Council are contained in the CON29 part of the Official Search. Additional enquiries regarding highway issues should be directed to the authority by the person, company or firm carrying out the Search. Full local authority search

A full search consists of the form LLC1 (which is the legal certificate relating to all registerable charges) and the form CON 29 (which deals with all enquiries relating to planning, highways and environmental history which may affect the property), both of which must be supplied in duplicate together with two plans. This type of search can be carried out by the postal submission of the correct forms (available to download below) and fee, or submitting the forms electronically through the National Land Information Service.

Turnaround times

As follows our target, turnaround time is 10 working days however, there  may be times ,due to lack of resources ,when this may not be met.

Forms

Forms can be emailed to: locallandcharges@tamworth.gov.uk. Please note, we must receive payment before we can process the forms. Payments can be made via our Pay It online service.

Fees

The search fees are (as of 1/4/2023):

  • LLC1 fee £31.00 each non vat
  • Commercial CON29R £152.00 plus VAT
  • Residential CON29R £111.00 plus VAT
  • One off questions £23.00 plus VAT
  • Extra questions (CON29O) £17.00 per question plus VAT
  • Additional parcels £12.00 plus VAT plus £1.05 extra LLC1 fee.

General advice

Please ensure that the correct payment is made (shown above) and can be made by cheque or our Pay It Online service. We will carry out a check to establish that the property is within the borough, that the fees are correct, and that all necessary forms and plans have been included. A VAT receipt for payment will be returned with the completed search. We aim to return searches within 10 working days.

Personal Searches

As an alternative to carrying out an Official Search undertaken by council staff, customers can opt to carry out a personal search of the Local Land Charges register. Requests can be made by email: locallandcharges@tamworth.gov.uk. Email must contain full postal address and a plan showing the boundary of the property, clearly marked in red.
