Court action for Tamworth resident who failed to comply with Community Protection Notice

A Tamworth resident who failed to comply and breached a Community Protection Notice, has been successfully prosecuted by Tamworth Borough Council.

On 4 July 2023, Mr Luke Davies (27) of Eringden, Stonydelph, at Cannock Magistrates’ Court, pleaded guilty to breaching a Community Protection Notice on 1July 2022, and ordered by magistrates to pay £300.

Mr Davies was prosecuted for failing to comply with a Community Protection Notice for anti-social behaviour and causing harassment, alarm and distress to staff at local businesses and distress within the community. The breach took place on several dates during early July 2022.

Davies told the court that he took responsibility for the offences, explaining that they were committed when under the influence of drink and drugs. He added that he had been clean for five months and had turned his life around. 

The magistrates therefore had a sympathy for Davies; they said they took at face value the fact that he had turned his life around. They ordered Davies to pay £300 towards costs with no separate fine for the offences on this occasion.

Councillor Martin Summers, Tamworth Borough Council’s Portfolio Holder for Environmental Health and Community Partnerships, said:” Being on the receiving end of anti-social behaviour is frightening, so we take all reports seriously and take appropriate actions with our community safety partners, including Tamworth Neighbourhood Policing Team.

“In this case Davies had breached the terms of his warnings, was issued with a Community Protection Notice which was also then breached. Breaking that notice was a serious offence, one we could not ignore, and the decision was taken to prosecute.

“We accept the decision of the court who have now reviewed the evidence and we do hope Davies has indeed ‘turned his life around’, supported by our commissioned support services. We will not hesitate to take further action as necessary should further evidence come forward.”
